Acceptance of Terms
These Terms govern your access to Percivo's web, mobile, and messaging-based products (collectively, the "Service"). By creating a workspace, connecting WhatsApp, or submitting orders, you agree to be bound by these Terms and our Privacy Policy.
Service Description
Percivo provides a unified operations platform for home and cloud kitchens to manage menus, WhatsApp/web orders, deliveries, payments, and customer feedback.
- Menu, availability, and inventory management.
- Order intake via WhatsApp templates, web widgets, or API integrations.
- Delivery slot scheduling, rider coordination, and prep workflows.
- Payment requests, recon, and lightweight loyalty or feedback tools.
- Automations, alerts, and analytics surfaced through the dashboard.
Merchant Responsibilities
If you operate a kitchen on Percivo you agree to:
- Provide accurate menu, pricing, allergen, and availability information.
- Obtain all licenses, food-safety approvals, and WhatsApp opt-ins required in your jurisdiction.
- Use customer contact details only for order fulfillment or communications the customer has consented to.
- Promptly update order statuses and honor delivery commitments.
- Maintain the confidentiality of your login credentials and restrict workspace access to authorized team members.
Customer Fees & Payments
- Merchants pay no subscription fee for the core platform.
- Customers paying via UPI or cash are charged a $0.10 (or local currency equivalent) convenience fee per order collected by Percivo as your processor.
- Customers who choose credit or debit cards may incur an additional 3% processing surcharge displayed at checkout.
- Payouts to merchants are handled through supported payment partners. Percivo never stores complete card numbers or bank credentials.
- Chargebacks, refunds, and disputes are the responsibility of the merchant; Percivo will pass through processor decisions.
Acceptable Use
You may not use the Service to send spam, promote illegal products, harvest data, interfere with other users, or attempt to reverse engineer the platform. Messaging features must comply with local telecom rules (including WhatsApp Business policies). We may suspend or terminate access if we detect abuse.
Service Availability & Support
We aim for high uptime but may perform maintenance or emergency changes. Certain integrations (WhatsApp, payment providers, delivery APIs) are provided "as is" and may be subject to their own outages or rate limits. Percivo is not responsible for third-party failures outside our reasonable control.
Data & Privacy
Our handling of personal data is described in the Privacy Policy. By using the Service you confirm you have the right to provide customer information to Percivo and to process it in accordance with applicable law.
Limitation of Liability
To the fullest extent permitted by law, Percivo is not liable for indirect, incidental, or consequential damages, lost profits, or business interruption resulting from your use of the Service. Total liability is limited to the greater of $100 USD or the fees you paid to Percivo in the preceding three months.
Termination
You may close your workspace at any time. We may suspend or terminate access immediately if you violate these Terms, harm customers, or create operational risk. Upon termination we will delete or anonymize workspace data according to our retention schedule.
Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California.
